Terms of Service

1. Who these terms are with

These terms are an agreement between you and:

They cover the Carpincho app for iOS and the website carpincho.app.

The app itself is licensed to you under the Apple Standard Licensed Application End User Licence Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. These terms govern our service around it: your account, syncing, pronunciation assessment, support, and the learning content. Where Apple's agreement and these terms both apply to the software licence, Apple's agreement prevails for that licence.

2. What Carpincho is

Carpincho is a vocabulary and speaking app for Rioplatense Spanish, with neutral Latin American and Spain variants included. It is a learning tool. It is not a translation service, not a certification, and not a substitute for language instruction where accuracy is critical.

The app works without an account. Content and audio are bundled with the app and run on your device.

3. Your right to use the app

We grant you a personal, non-exclusive, non-transferable right to use Carpincho for your own learning, on devices you control, for as long as these terms apply.

You may not sublicense, rent, sell or redistribute the app, nor make it available to third parties as a service.

4. Account

An account is optional. It syncs your progress across devices and raises your daily quota for pronunciation assessment.

5. Pronunciation assessment and fair use

Pronunciation assessment sends your recording to an external speech service, which costs us money per second of audio. It is therefore subject to a quota: a small number of assessments without an account, and a higher daily limit with one.

We may adjust these quotas where this is necessary for technical, security or economic reasons, and we may limit or suspend access where use is automated, abusive, or clearly outside normal learning — for example scripted requests or attempts to circumvent the quota. We will not do this to ordinary use, however intensive.

Assessment is an approximation produced by software. A good result is not a guarantee that you will be understood, and a poor one is not a verdict on your Spanish.

6. Paid features

Carpincho currently has no paid features. If we introduce them:

7. Content, intellectual property and the data set

The app, the website, the name Carpincho, the logo, the mascot, the design and the source code belong to us.

The learning data set is separately protected. The vocabulary and sentence collection — the selection of entries, the regional variants, the translations, the categorisation, the register and metadata, and the associated audio recordings — constitutes a database within the meaning of §§ 87a ff. of the German Copyright Act (UrhG), created through substantial investment. We are its maker.

You may not extract or re-utilise the database or a substantial part of it, and you may not repeatedly and systematically extract or re-utilise insubstantial parts. This applies in particular to automated retrieval, scraping, bulk export, and the reproduction of the data set in another product.

Reservation of rights for text and data mining: we reserve the use of all our content and data, including the data set described above, for text and data mining within the meaning of § 44b (3) UrhG and Art. 4(3) of Directive (EU) 2019/790. Use of this content to train, fine-tune or evaluate machine learning models is not permitted.

Personal, non-commercial use of the content for your own learning is of course permitted. That is what the app is for.

9. Availability and changes

Carpincho is offered as it currently exists. We may change, add or discontinue features, and we may discontinue the service as a whole. Where a change materially reduces the usefulness of the service to you, we will give reasonable notice before it takes effect and, where paid features are affected, offer you a way to end the paid relationship.

We do not guarantee uninterrupted availability. Maintenance, outages at our providers, and app store review processes can all interrupt the service.

Statutory obligations remain unaffected, in particular the update obligation for digital products under § 327f BGB described in section 11.

10. Suspension and termination

You may stop using Carpincho at any time by deleting your account or the app.

We may suspend or terminate access if you materially breach these terms, in particular sections 5, 7 or 8. Where the breach can be remedied, we will say what the issue is and give you an opportunity to remedy it before terminating, unless immediate action is necessary.

11. Conformity and warranty

Statutory rights on defects apply. For paid digital products, and for free ones where these provisions apply, this includes the conformity and update obligations under §§ 327 ff. of the German Civil Code (BGB), which we do not exclude or limit.

Beyond that, we do not warrant that the app is free of errors, that content is complete or suitable for a particular purpose, or that using it will produce a particular level of language ability.

12. Liability

We are liable without limitation for damages arising from injury to life, body or health, for intent and gross negligence, under the German Product Liability Act, and where we have given a guarantee.

In cases of slight negligence, we are liable only for the breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and in that case only for the foreseeable damage typical for this type of contract.

Any further liability is excluded.

13. Age

Carpincho is not directed at people under 16. If you are under 16, please do not create an account.

14. Website and waitlist

The website is informational. Joining the waitlist means you consent to occasional emails about Carpincho; you can unsubscribe at any time via the link in any email or at privacy@52n34s.com.

15. Data protection

How we handle personal data is described in our Privacy Policy at carpincho.app/privacy. That document is information, not an agreement — there is nothing in it for you to accept.

16. Governing law and consumer rights

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer with your habitual residence in another EU member state, this choice of law does not deprive you of the protection of mandatory provisions of the law of that state.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Changes to these terms

We may change these terms where there is a valid reason — for example a change to the service, or to legal requirements. We will notify you of material changes before they take effect, in the app or by email, and tell you what has changed. If you do not accept a change, you may stop using the service and delete your account.

The current version is always at carpincho.app/terms.
